These Terms of Use ("Terms") govern your use of the Zenith Habit Tracker app ("Zenith", "the app"). By downloading or using Zenith, you agree to these Terms. If you do not agree, please do not use the app.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Zenith on Apple devices you own or control, in accordance with the Apple App Store Terms of Service and these Terms.

2. Subscriptions (Zenith Pro)

Zenith offers an optional auto-renewing subscription, "Zenith Pro", which unlocks additional features. The following applies:

3. Acceptable use

You agree not to misuse the app, including by attempting to reverse engineer it, interfere with its operation, abuse the AI features, or use it for any unlawful purpose.

4. Analytics

Zenith collects anonymous usage analytics (such as which screens you open and subscription funnel events) through our analytics provider, PostHog, as described in our Privacy Policy. We do not use analytics for advertising or cross-app tracking.

5. AI features

Zenith includes AI-assisted features that generate suggestions, tasks and insights. These outputs are generated automatically, may be inaccurate, and are provided for convenience only. You are responsible for reviewing them before relying on them.

Fair-use limits (Zenith Pro). AI features are available to Zenith Pro subscribers subject to fair-use limits, currently 50 AI requests per day and 300 per month per device (billable generations counted server-side). Brain Dump and related features may use additional processing; the same limits apply. We may change these limits; material changes will be reflected in an updated “Last updated” date below.

You agree not to circumvent, automate, or abuse these limits or the AI infrastructure (see Section 3).

Zenith is a productivity and habit-tracking tool. It does not provide medical, psychological, financial, or other professional advice, and is not a substitute for professional care. Always seek qualified advice for such matters.

7. Your content

You retain ownership of the content you create in Zenith. Because your content is stored on your device, you are responsible for maintaining your own backups.

8. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your requirements. Nothing in these Terms excludes rights you may have under applicable consumer law (including the Australian Consumer Law) that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the 12 months before the claim.

10. Changes

We may update the app and these Terms from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law principles. This does not deprive you of consumer protections in your country of residence.
